American no-fault divorce law- texas?
has the couple been in the US together at all? If not, then I'd say no, because the marriage isnt recognized as legal in the states until both parties are actually in the states. I went through the same bs with my ex, and I'm from texas too. I tried to file here, and even called an indian divorce lawyer, and she said that if he hasnt set foot in the US, then it's hard to file since the marriage isnt recognized in the states. So I had to go back to india and file for divorce. And, yes, in india she can file for divorce accusing him of his faults. I did this, and my divorce case took six months. He filed in kerala, india first, but due to his truancy, it got thrown out. he petitioned to re-open it six months later, and that's when I filed for divorce. As far as I know, his case is still pending, but mine is closed. I got the divorce based on cruelty. But of course, he never showed up to my hearings. I heard he barely showed up to his own...but I went to one of his hearings when I was in kerala and did see him. Anyway, turns out he didnt need a divorce or an annulment like we all think u need to wed in a church, because he got married b4 he got word the divorce was final. Our annulment is still pending; but he got married in the church anyway. That's indian justice for u. Aint life grand?!
